The Short Version

A new federal rule takes effect on December 11, 2026. It was written to stop synthetic, intoxicating hemp products, but the language is broad enough to catch full-spectrum CBD too, the kind that's been tested, labeled, and sold legally for years. If it stands as written, most full-spectrum CBD on the market, including ours, would no longer meet the federal definition of hemp.

December 20, 2018

The 2018 Farm Bill is signed into law, federally legalizing hemp and hemp-derived cannabinoids containing no more than 0.3% Delta-9 THC.

November 2025

A new THC concentration limit of 0.4mg per container is added to a federal spending bill without a public hearing or standalone debate.

Where Upstate Elevator Stands

Hemp prohibition is the wrong approach and a step backward for sensible cannabis policy. Instead of taking legal hemp products away from adults, we believe the path forward is clear, responsible regulation that protects children and consumers and preserves access.

Upstate supports the following regulatory principles to create a safe, thriving, and transparent hemp beverage industry.

Age restriction - The sale of cannabinoid-infused beverages should be restricted to adults aged 21 years or older.
Safety - The safety of the consumer is paramount and should be a driving force in the industry.
Serving size and potency- THC levels should be safe, effective, and provide value to the consumer.
Labeling- Clear, consistent labeling is necessary to empower the consumer and build credibility for the industry.

Regulatory clarity- Regulations are necessary and should be thoughtful, concise, and support consumer safety and industry growth.
Marketplace consistency- A federal framework is necessary to ensure consumer confidence, marketplace consistency, regulatory clarity and public safety. In lieu of federal action, state governments should work together to develop guidelines that are consistent across state lines.

We’re working with the U.S. Hemp Roundtable to advocate for commonsense regulations that protect consumers while preserving access to safe, legal full-spectrum CBD products.
